Legal Terms and Conditions

General Terms

These conditions apply to your account with ATYMOS - ENGINEERING SOLUTIONS, as well as to our services, and they form a binding agreement between you and us.

1. Acceptance

By registering your account or subscribing to our services, or by accessing or using our Offerings, you acknowledge that you accept these General Terms and any related Terms, agreeing to be bound by this contract. If you do not consent to these Terms, you must refrain from accessing or using our Offerings.

You agree to these Terms on behalf of the organization or legal entity you represent (such as your employer or client) or, if no such entity is involved, on your own behalf as an individual (“You”). You affirm that you possess the authority and legal capacity (e.g., being of legal age) to act on behalf of and legally bind that entity, if applicable, and yourself.

2. Specific Conditions

 

Certain Offerings might be governed by specific conditions outlined in the Special Terms or within the Documentation associated with those Offerings (“Special Terms”). By subscribing to, accessing, or using any Offering, you agree to comply with the relevant Special Terms.

3.  Refund Eligibility

Within a specified period, if you (a) disagree with any of these Terms, (b) take issue with any ATYMOS - ENGINEERING SOLUTIONS purchase or auto-renewal conditions, or (c) are unsatisfied with the Offering you subscribed to for any reason, you may return the Offering and potentially be eligible for a refund in accordance with the ATYMOS - ENGINEERING SOLUTIONS Return Policy.

4. Account Responsibility

You are responsible for anyone who accesses or uses Offerings through your account, including ur Authorized Users, and ensuring their compliance with these Terms as if they were you. In some cases, Authorized Users may need to create individual accounts or agree to specific terms to access or use the Offerings, but you remain accountable. You also agree to keep your user IDs and passwords secure and not share them (except with authorized account administrators). If you suspect unauthorized use of your account, please contact ATYMOS - ENGINEERING SOLUTIONS

5. Ownership of Your Work

You retain ownership rights to any files, data sets, documents, or similar materials created by you (or your Authorized Users) and submitted or uploaded to an Offering by you (or your Authorized Users).

6. Privacy Commitment

ATYMOS - ENGINEERING SOLUTIONS is dedicated to protecting your privacy and informing you about how your personal data will be handled. ATYMOS - ENGINEERING SOLUTIONS Privacy Statement outlines how ATYMOS - ENGINEERING SOLUTIONS may collect, use, store, and process your personal data, and how you can request access to or deletion of your personal data.

7. Subscription Term

Alls subscription are for a period of 1 (One) month. The duration of the Offering Term will be indicated in the Offering Identification. All subscriptions may automatically renew. If you wish to cancel an automatic renewal, please refer to Cancelling Automatic Renewal for Subscriptions.

8. Offerings

8.1 Rights to Offerings
For any Offering, you are granted a non-exclusive right to use the Offering, provided you comply with these Terms and fulfill all payment obligations, including taxes and fees. This right allows you (and your Authorized Users) to use the Offering only (a) during the specified Offering Term, (b) according to any applicable Special Terms, and (c) within the scope of your subscription, including the allowed number of users, Offering Type, Territory, and other attributes you selected at the time of subscription. If your Offering Identification does not specify these attributes, the Offering will be treated as a Trial Version.

Unless explicitly permitted by these Terms or granted in writing by ATYMOS - ENGINEERING SOLUTIONS, you are not allowed to (i) reproduce, modify, adapt, translate, port, or create derivative works of any portion of the Offering, except where allowed by applicable law, or (ii) sublicense, transfer, distribute, transmit, sell, lease, rent, loan, or otherwise make available any portion or functionality of the Offering to a third party. Any Software provided by ATYMOS - ENGINEERING SOLUTIONS, including Updates or Upgrades, is licensed to you for a limited subscription period, not sold. You may create one archival copy of the Software solely for backup purposes during the Offering Term.

8.2 Access to Software and Cloud Services
During the Offering Term, ATYMOS - ENGINEERING SOLUTIONS will provide you with access to Offerings through your account or other electronic means, contingent on your compliance with these Terms. ATYMOS - ENGINEERING SOLUTIONS is not responsible for any losses or liabilities incurred by you or others due to incorrect account information being sent. You may need to log into your account or provide additional information to ATYMOS - ENGINEERING SOLUTIONS to activate, access, or use an Offering. Some Offerings may automatically connect your devices to the internet to validate your subscription, grant access to services, or download and install Updates or Upgrades, without further notice.

During the Offering Term, ATYMOS - ENGINEERING SOLUTIONS may deliver Updates or Upgrades to the Software. You must promptly install any mandatory Updates.

9. Trial Versions
ATYMOS - ENGINEERING SOLUTIONS may offer "Trial Versions" of Offerings, labeled as “not for resale,” “free,” “evaluation,” “trial,” “pre-release,” “beta,” or similar designations. Unless otherwise stated in the Documentation or Special Terms, (a) you may use the Trial Version only for 15 days from download, (b) your use is limited to non-commercial evaluation, (c) the Trial Version is for use only by you as an individual or by one named employee if you are an entity, and (d) it may only be used within the Territory where you acquired it. ATYMOS - ENGINEERING SOLUTIONS makes no commitments regarding Trial Versions, including future availability or upgrades, and Trial Versions may contain untested code that could cause data loss or system failure. Subscriptions to Trial Versions do not include subscription Benefits, and ATYMOS - ENGINEERING SOLUTIONS may end any Trial Version at any time without notice.

 

10. Feedback

If you provide ATYMOS - ENGINEERING SOLUTIONS with ideas for improvement, suggestions, or any other feedback (collectively, “Feedback”), you grant ATYMOS - ENGINEERING SOLUTIONS a non-exclusive, transferable, irrevocable, worldwide, royalty-free license (with the right to sublicense) to make, use, sell, offer to sell, reproduce, modify, distribute, make available, publicly display, perform, disclose, and otherwise exploit the Feedback and any Offerings that incorporate the Feedback.

 

Limitations on Use

11.1 Offerings as Tools

The Offerings are intended solely as tools to assist with management. They are not substitutes for your professional judgment or your own independent work in these areas,. You acknowledge that the Offerings may not have been tailored or tested for your specific needs, and the results or Output may not meet your desired outcomes within your constraints. It is your responsibility to: (a) determine the appropriateness of an Offering for your purposes, (b) establish the proper use of the Offerings, and (c) select the Offerings, to achieve your intended results. You acknowledge that, between you and ATYMOS - ENGINEERING SOLUTIONS, you bear sole responsibility for: (i) your use (and that of your Authorized Users) of the Offerings and any resulting Output, and (ii) implementing independent procedures to verify the reliability, safety, accuracy, completeness, and other characteristics of any Output, including insights, recommendations, and all items designed with the aid of the Offerings. ATYMOS - ENGINEERING SOLUTIONS will not be held responsible or liable for any results obtained through the use of the Offerings, including any Output.

11.2 Acceptable Use of Offerings

You will access and use the Offerings (and allow access and use by others) strictly in compliance with the Acceptable Use Policy and all applicable laws.

12. ATYMOS - ENGINEERING SOLUTIONS Proprietary Rights

You acknowledge and agree that ATYMOS - ENGINEERING SOLUTIONS and its licensors and suppliers retain ownership and all rights related to (a) the Offerings, Documentation, APIs, and other materials provided by ATYMOS - ENGINEERING SOLUTIONS, including copies, (b) any materials or information derived from or based on the above (including Metrics), and (c) all associated intellectual property and proprietary rights, including trade secrets, copyrights, trademarks, patents, and others. The structure, organization, underlying algorithms, protocols, data structures, and source code of the Offerings and APIs are proprietary and confidential to ATYMOS - ENGINEERING SOLUTIONS, and you will not disclose or use this information outside the ordinary-course access and use of the Offerings as specified in these Terms, without ATYMOS - ENGINEERING SOLUTIONS ‘s prior written consent. You will not attempt to access the Offerings by any means other than the interface provided by ATYMOS - ENGINEERING SOLUTIONS, nor will you engage in decompiling, disassembling, or reverse engineering, or attempt to discover the structure, organization, underlying algorithms, or source code of the Offerings or APIs, except as permitted by applicable law despite contractual prohibitions. ATYMOS - ENGINEERING SOLUTIONS may also provide access to other confidential and proprietary information, deemed as such under the circumstances, to facilitate your access or use of the Offerings, and this information will also be treated as ATYMOS - ENGINEERING SOLUTIONS Confidential Information. Your rights under these Terms are limited to those explicitly granted. All other rights are reserved by ATYMOS - ENGINEERING SOLUTIONS and its licensors and suppliers, and ATYMOS - ENGINEERING SOLUTIONS expressly disclaims (and you agree not to assert) any other rights.

13. Limited Warranty, Disclaimers, Limitations on Liability

13.1 Limited Warranty

ATYMOS - ENGINEERING SOLUTIONS warrants that for any paid subscription, as of the date the Offering is made available to you and for 30 days thereafter, or for the duration of the Offering Term if shorter, the Offering will provide the general features and functions described in the end-user Documentation.

ATYMOS - ENGINEERING SOLUTIONS ‘s obligation and liability, and your sole and exclusive remedy for a breach of this warranty, will be for ATYMOS - ENGINEERING SOLUTIONS to either (a) reasonably attempt to correct the breach or (b) Refund the amount paid for the affected subscription (proportional to the remaining time and deducting the taxes related to the transfer)) and terminate it. Any warranty claims must be made within the applicable Warranty Period, or they will be excluded.

13.2 Disclaimers

EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 14.1 AND ANY EXPRESS WARRANTIES IN ANY ADDITIONAL AGREEMENT OR SPECIAL TERMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, (a) THE OFFERINGS ARE PROVIDED “AS IS,” “WITH ALL FAULTS,” AND WITHOUT ANY WARRANTY OR CONDITION, AND (b) ATYMOS - ENGINEERING SOLUTIONS AND ITS LICENSORS AND SUPPLIERS MAKE NO WARRANTIES, REPRESENTATIONS, CONDITIONS, OR COMMITMENTS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY OF THE OFFERINGS OR OUTPUT.

Statements by ATYMOS - ENGINEERING SOLUTIONS or its agents about the Offerings or Output that are not contained in these Terms are for informational purposes only and do not constitute a warranty or commitment. ATYMOS - ENGINEERING SOLUTIONS and its licensors do not warrant that (i) the Offerings or Output will be available, uninterrupted, timely, error-free, or secure, (ii) the Offerings will meet any performance criteria, (iii) your Content will not be lost or damaged, or (iv) errors or defects will be corrected. Unlimited access or use of Offerings is subject to technical limitations, and some Offerings or functionalities may not be available in all locations or languages.

13.3 Limitations on Liability

ATYMOS - ENGINEERING SOLUTIONS  WILL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS; BUSINESS INTERRUPTION; OR LOSS, CORRUPTION, OR DELETION OF DATA OR CONTENT. THE TOTAL LIABILITY OF ATYMOS - ENGINEERING SOLUTIONS  WILL NOT EXCEEDTHE AMOUNT PAID BY YOU FOR THE OFFERING IN THE PAST MONTH. YOU AGREE THAT THESE LIMITATIONS ARE ESSENTIAL TO THE AGREEMENT BETWEEN YOU AND ATYMOS - ENGINEERING SOLUTIONS AND THAT ATYMOS - ENGINEERING SOLUTIONS WOULD NOT PROVIDE THE OFFERINGS WITHOUT THEM. THE LIMITATIONS WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW, REGARDLESS OF THE THEORY OF LIABILITY, AND EVEN IF ATYMOS - ENGINEERING SOLUTIONS WAS ADVISED OF THE POSSIBILITY OF LIABILITY.. CERTAIN WARRANTIES, CONDITIONS, REMEDIES, OR LIABILITIES THAT CANNOT BE EXCLUDED BY LAW MAY APPLY, AND THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS THAT MAY VARY BY JURISDICTION.

14. Term, Termination, Suspension

These Terms are effective upon acceptance and continue indefinitely unless terminated.

13.1 Your Right to Terminate

You may terminate if ATYMOS - ENGINEERING SOLUTIONS materially breaches these Terms and fails to cure the breach within 5 days of notice.

14.2 ATYMOS - ENGINEERING SOLUTIONS ‘s Right to Terminate or Suspend

ATYMOS - ENGINEERING SOLUTIONS may terminate or suspend access if you have no current paid subscriptions, fail to pay, breach these Terms without curing the breach, or become insolvent. ATYMOS - ENGINEERING SOLUTIONS may also disable access if your conduct poses security risks or otherwise adversely impacts Offerings.

15. Term, Termination, Suspension

15.1 Effective Date and Duration These Terms become effective on the date you accept them in accordance with Section 1 (Acceptance) and will remain in effect indefinitely unless terminated as provided in these Terms, including this Section 16.

15.2 Your Right to Terminate You may terminate your subscriptions and these Terms if ATYMOS - ENGINEERING SOLUTIONS materially breaches these Terms and fails to remedy the breach within 5 days of receiving written notice of the breach.

15.3 ATYMOS - ENGINEERING SOLUTIONS ‘sRight to Terminate or Suspend ATYMOS - ENGINEERING SOLUTIONS may terminate (or disable or suspend your access to and use of) any or all of your subscriptions or other Offerings, or terminate these Terms and your account, if any of the following conditions are met: (a) You have no active paid subscriptions; (b) You fail to pay any amounts owed to ATYMOS - ENGINEERING SOLUTIONS (including fees and taxes) in a timely manner; (c) You (or any of your Authorized Users) materially breach these Terms and fail to remedy the breach within 5 days of receiving written notice; (d) You become subject to bankruptcy or insolvency proceedings, become insolvent, make an arrangement with creditors (including an assignment for the benefit of creditors), or commence liquidation.

If you go into liquidation, these Terms will automatically terminate without further notice from ATYMOS - ENGINEERING SOLUTIONS. ATYMOS - ENGINEERING SOLUTIONS may also immediately disable or suspend your access to Offerings and your Content if ATYMOS - ENGINEERING SOLUTIONS, in good faith, believes that your (or your Authorized Users’) actions or inactions, or your Content, could: (i) pose a security risk, involve illegal activity, or otherwise adversely affect Offerings, systems, or other users; (ii) tamper with, remove, disable, or otherwise affect any technical protections; or (iii) expose ATYMOS - ENGINEERING SOLUTIONS, its suppliers, resellers, distributors, users, or similar third parties to liability.

15.4 Effect of Subscription Termination Upon expiration or termination of a subscription or other Offering for any reason, your rights to that Offering will end. You must cease all access to and use of the Offering, uninstall all related materials (including Software, Documentation, APIs, or other ATYMOS - ENGINEERING SOLUTIONS materials), and, upon ATYMOS - ENGINEERING SOLUTIONS ‘s request, either destroy or return such materials.

15.5 Effect of Termination of Terms or Account If these Terms are terminated for any reason: (a) Your account, subscriptions, and other Offerings, including those of your Authorized Users, will immediately terminate. (b) The effects described above for subscription termination will also apply to all subscriptions and Offerings associated with your account.

16. Miscellaneous

16.1 Changes to the Offerings ATYMOS - ENGINEERING SOLUTIONS reserves the right to (a) modify, discontinue, or replace an Offering (including any Benefits, features, functionality, or supporting services related to the Offering), or (b) add or change license keys, authorizations, or other means of controlling or measuring access to or use of the Offerings. ATYMOS - ENGINEERING SOLUTIONS will try to notify you of major changes to an Offering through release notes or other Documentation.

16.2 Changes to Terms ATYMOS - ENGINEERING SOLUTIONS may modify these Terms from time to time, as permitted by applicable law. ATYMOS - ENGINEERING SOLUTIONS will attempt to notify you of any changes (“Terms Modification Notice”), which may be posted on this site. It is your responsibility to regularly check for updates, including Terms Modification Notices. If a modification adversely affects you and you do not agree, you may reject the modification by notifying ATYMOS - ENGINEERING SOLUTIONS within 5 days of the Terms Modification Notice. If you reject a modification: (a) Your access to and use of the affected Offerings will be governed by the terms in effect immediately before the modification until the earlier of the end of the applicable Offering Term or 5 days after the Terms Modification Notice; and (b) Your rights to such Offerings, including related subscription Benefits, will terminate. ATYMOS - ENGINEERING SOLUTIONS (or the party from whom you purchased your subscription) will refund the prorated portion of any prepaid fees applicable to the remaining Offering Term after the effective date of termination. If a subscription is renewed or extended, it will be under the then-current Terms.

16.3 Language of Terms, Interpretation The English version of these Terms will be used for interpretation. Notices or communications related to these Terms will be in English. References to “days” are calendar days unless specified otherwise. The terms “including” and “for example” are not limiting and are followed by “without limitation.” Section and other headings are for reference only and do not affect interpretation. Rights and remedies under these Terms are cumulative and additional to other rights available under applicable law.

16.4 Force Majeure

Neither party will be liable for any delay or failure to perform due to unforeseen circumstances or causes beyond its reasonable control, including natural disasters, earthquakes, fires, pandemics, floods, sanctions, embargoes, strikes, lockouts, labor disputes, civil unrest, unavailability or delays of suppliers or licensors, riots, terrorist acts, wars, internet outages, power failures, actions or orders from civil or government authorities, and severe weather conditions (collectively, "Force Majeure"). The affected party must provide prompt written notice to the other party (when possible) of the delay or failure and make reasonable efforts to minimize the resulting delay in performance.

16.5 Verification of Compliance

ATYMOS - ENGINEERING SOLUTIONS reserves the right to verify your compliance with these Terms and may do so by providing you with a report on your non-compliant use of Offerings or by conducting a remote or on-site audit ("Verification"). If an audit is required, ATYMOS - ENGINEERING SOLUTIONS or its representative will notify you electronically. You must use an ATYMOS - ENGINEERING SOLUTIONS -approved tool to gather information from all devices accessing your Offerings and obtain necessary access and consent from your authorized users. Within 15 calendar days of the audit notification, you must submit your audit results, including machine IDs, serial numbers, ATYMOS - ENGINEERING SOLUTIONS IDs, NT/Windows usernames, device IDs, and other relevant information. If ATYMOS - ENGINEERING SOLUTIONS determines you are in violation of these Terms, you must immediately purchase new Offerings to cover the value of the identified non-compliance and ATYMOS - ENGINEERING SOLUTIONS reasonable costs for the Verification. Failure to comply with this section constitutes a material breach, and ATYMOS - ENGINEERING SOLUTIONS reserves the right to suspend or terminate your access to Offerings and seek other legal remedies.

16.6 Assignment

You may not assign or transfer these Terms or your rights or obligations under these Terms without ATYMOS - ENGINEERING SOLUTIONS ‘sprior written consent. ATYMOS - ENGINEERING SOLUTIONS may terminate these Terms if you are acquired or controlled by another entity without such consent. ATYMOS - ENGINEERING SOLUTIONS may assign or transfer these Terms as part of a reorganization, merger, sale of assets, or other transaction involving the Offerings or related business, without your consent.

16.7 Severability

If any provision of these Terms is held unenforceable under applicable law, (a) the provision will be modified as necessary to conform to the law while giving maximum effect to the intent of the parties, and (b) the provision will be ineffective only in the jurisdiction where it is held unenforceable, without affecting enforceability in other jurisdictions.

16.8 Notices

16.9 Entire Agreement, No Waiver

These Terms, including any Additional Agreement and Special Terms, constitute the entire agreement between you and ATYMOS - ENGINEERING SOLUTIONS, superseding all prior agreements or understandings. Any access to or use of an Offering is conditioned on these Terms. If there is a conflict between General Terms and Special Terms, the Special Terms will prevail. If there is a conflict between General Terms, Special Terms, and an Additional Agreement, the Additional Agreement will control as specified. Failure to enforce any provision is not a waiver unless specifically agreed to in writing by the party against which the waiver is asserted.

Definitions

“Additional Agreement” refers to any agreement entered into directly with an ATYMOS - ENGINEERING SOLUTIONS entity that explicitly supplements or amends the Terms (e.g., an enterprise business agreement).

“Authorized Users” or “Your Authorized Users” means (a) you (if you are an individual) and (b) identified individuals (such as your employees, consultants, contractors, and others accessing and using an Offering) for whom you have acquired a subscription. If an Offering allows you to designate Authorized Users, you are responsible for notifying and obtaining consent from these users regarding the application of these Terms to their access and use of the Offering before they access or use it.

“ATYMOS - ENGINEERING SOLUTIONS” refers to ATYMOS - ENGINEERING SOLUTIONS, Inc., a corporation incorporated in Belo Horizonte (Brazil) .

“Benefits” refers to any advantages provided to you or your Authorized Users by ATYMOS - ENGINEERING SOLUTIONS. Benefits typically depend on the type or level of Offering for which you subscribe and may include access to Updates and Upgrades, rights to previous versions, technical support, training, webinars, forums, events, galleries, newsletters, and usage data. Benefits may also encompass account-related features such as single sign-on and profile management, security settings, linked accounts, and preferences.

“Confidential Information” refers to information not generally known to the public that is (a) disclosed by a Disclosing Party to a Receiving Party in writing and (b) designated as Confidential by the Disclosing Party. However, Confidential Information does not include (i) information that (1) becomes public without breach of any obligation to the Disclosing Party; (2) was known to the Receiving Party before receipt from the Disclosing Party without any confidentiality obligation; (3) is received from a third party without breach of any confidentiality obligation; or (4) was independently developed by the Receiving Party; (ii) any of your content that you share with or allow a third party to access through an Offering; or (iii) any Feedback. ATYMOS - ENGINEERING SOLUTIONS Confidential Information includes the non-public aspects of (A) any Offerings, related product plans, technology, and technical information (including APIs and any elements of your development using or based on APIs) and (B) business negotiations.

“Customer Information Form” means a form completed by or on your behalf and submitted to ATYMOS - ENGINEERING SOLUTIONS (or to a reseller, distributor, or other third party) in connection with your account, subscription, or other Offering.

“Documentation” refers to the current end-user documentation (whether online, printed, or otherwise) and any technical or legal requirements for an Offering.

“Governmental Entity” means any nation or government, , any state, municipality, or other political subdivision thereof, as well as any entity, body, agency, commission, department, board, bureau, or judicial body related to government, and any employee or official thereof.

“Metrics” means data and other information about the access to and use of any Offerings (including your access and use). Metrics include information about feature usage, storage, indexes, and usage of your content (but not the content itself). If Metrics include personal data, its treatment will comply with the Privacy Statement.

“Offerings” includes Software, and Benefits provided by ATYMOS - ENGINEERING SOLUTIONS, as well as any subscriptions for these items.

“Offering Identification” refers to designations provided by ATYMOS - ENGINEERING SOLUTIONS that outline (as applicable) the name of an Offering; the Offering Type; and the permitted number, Territory, and length of your subscription. Offering Identification may be (a) provided in a written confirmation or notice from ATYMOS - ENGINEERING SOLUTIONS, posted to your account, sent via email, or otherwise made available to you; (b) located within the Offering or on its packaging; or (c) obtained from ATYMOS - ENGINEERING SOLUTIONS upon request. Offering Identification does not include any designation or confirmation provided by a reseller, distributor, or other third party.

“Offering Type” refers to the license type specified by ATYMOS - ENGINEERING SOLUTIONS for a subscription (e.g., single-user, multi-user, or Flex). Offering Types are detailed in Offering Types and Benefits.

“Output” means all results, work products, designs, prototypes, or other items created or generated through the use of any Offering, including any products, parts, or services based on or using such results, work products, designs, prototypes, or other items.

“Software” means any software or similar materials, including modules, components, features, and functions, provided by ATYMOS - ENGINEERING SOLUTIONS, whether or not as part of a subscription or for a fee. Software includes Updates and Upgrades.

“Terms” (including “these Terms”) refers to these General Terms and the other terms referenced within, including Special Terms and any Additional Agreement (if applicable), along with any other applicable terms.

“Territory” means the country or jurisdiction where you acquired your subscription. ATYMOS - ENGINEERING SOLUTIONS may specify the applicable Territory in the Offering Identification. For more information on the definition of Territory, see Section 19 (Country/Jurisdiction-Specific Terms) below.

“Updates” refers to security fixes, hot fixes, patches, and other updates (including new features, functions, and modifications released between Upgrades).

“Upgrades” means new versions of Offerings, or add-ons or additional products related to Offerings, as determined by ATYMOS - ENGINEERING SOLUTIONS.

“Your Content” refers to (a) any files, designs, models, data sets, images, documents, or similar materials submitted or uploaded to any Offering by you (or your Authorized Users) and (b) specific output generated from using any Offering based on your own raw data or information.
